Agreement

All retainers are non-refundable unless otherwise stated in this Agreement.

Booth Space Requirements

Client agrees to provide:

  • Adequate space for booth operation
  • A standard electrical outlet within reasonable distance of the booth location
  • A flat and stable setup surface
  • Protection from rain, moisture, and extreme weather
  • Safe access for setup and teardown

Venue Requirements

Client is responsible for:

  • Obtaining venue approval if required
  • Providing venue access instructions
  • Communicating venue restrictions before the event
  • Ensuring a safe environment for guests, staff, and equipment

Company is not responsible for delays caused by venue restrictions, loading procedures, elevator access, security requirements, or other venue-related issues.

Power Requirements

Client is responsible for providing reliable electrical power.

Company is not responsible for interruptions caused by:

  • Power outages
  • Electrical failures
  • Venue utility issues
  • Inadequate power supply

Outdoor Events

Outdoor events must provide protection from:

  • Rain
  • High winds
  • Excessive heat
  • Direct sunlight
  • Unsafe weather conditions

Company reserves the right to suspend service if conditions become unsafe for guests, staff, or equipment.

Venue Interference

Company is not responsible for service interruptions caused by:

  • Venue staff
  • Security personnel
  • Internet outages
  • Utility failures
  • Venue restrictions
  • Circumstances beyond Company's control

Internet & Digital Sharing

Certain features of the photo booth may require internet access, including:

  • Text sharing
  • Email sharing
  • Cloud uploads
  • Online galleries
  • Social media sharing

Client understands that internet availability is controlled by the venue and local service providers.

Company does not guarantee internet access, WiFi availability, cellular coverage, or upload speeds.

Lack of internet access shall not be considered a failure to perform contracted services.

Online Gallery

When included with the selected package, Company will provide an online gallery containing event images.

Client acknowledges:

  • Gallery availability periods may vary.
  • Images should be downloaded promptly.
  • Company may remove galleries after the designated hosting period.
  • Company is not responsible for images lost after gallery expiration.

Photo Release

Client grants Company permission to use photographs, videos, GIFs, boomerangs, and other media captured during the event for:

  • Marketing
  • Advertising
  • Social media
  • Website content
  • Portfolio use
  • Promotional materials

Company will not intentionally use media in a misleading, offensive, or inappropriate manner.

If Client does not wish to allow promotional use of event media, Client must notify Company in writing before the event date.

Company retains ownership of all original media files unless otherwise agreed in writing.

Children & Guest Supervision

Children using the photo booth remain the responsibility of their parent, guardian, or supervising adult.

Company staff are not responsible for supervising children.

Client agrees that children should not:

  • Climb on equipment
  • Interfere with booth operation
  • Handle printers or electronics
  • Create unsafe conditions around the booth

Company shall not be responsible for injuries resulting from unsupervised use of the photo booth area.

Guest Conduct

Company reserves the right to suspend operation if guests engage in behavior that may:

  • Damage equipment
  • Endanger guests
  • Endanger staff
  • Create unsafe working conditions

Examples include:

  • Aggressive behavior
  • Harassment
  • Excessive intoxication
  • Physical interference with equipment
  • Dangerous conduct

No refunds will be provided for interruptions resulting from unsafe guest behavior.

Safe Working Environment

Client agrees to provide a safe and respectful environment for Company personnel.

Company reserves the right to terminate services immediately if staff experience:

  • Threats
  • Harassment
  • Physical intimidation
  • Discrimination
  • Illegal activity
  • Unsafe working conditions

If services are terminated due to unsafe conditions, all payments made shall be retained by Company and no refunds shall be issued.

Alcohol & Illegal Activity

Company reserves the right to refuse participation in activities involving:

  • Illegal conduct
  • Illegal substances
  • Dangerous behavior
  • Activities that place staff or equipment at risk

Services may be terminated without refund if such conditions exist.

Service Interruptions

Company shall not be liable for interruptions caused by circumstances beyond its reasonable control, including:

  • Venue restrictions
  • Power outages
  • Internet outages
  • Severe weather
  • Government actions
  • Emergencies
  • Fires
  • Floods
  • Natural disasters
  • Civil disturbances
  • Public health emergencies

Company will make reasonable efforts to continue service whenever possible.

Cancellation Policy

The booking retainer is non-refundable.

Because Company reserves the event date and may decline other bookings, retainers will not be returned if the event is cancelled.

If Client cancels the event:

  • Retainer payments are forfeited.
  • Additional payments may be refunded at Company's discretion depending upon timing and circumstances.

Rescheduling Policy

Company will make reasonable efforts to accommodate a new event date.

Rescheduling is subject to:

  • Company availability
  • Written approval
  • Payment status

Rescheduling is not guaranteed.

Company Cancellation

In the unlikely event Company cannot perform services due to illness, emergency, accident, equipment loss, or circumstances beyond its control, Company's liability shall be limited to the return of monies paid by Client.

Company may attempt to secure a replacement provider but does not guarantee replacement availability.

Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control.

Examples include:

  • Natural disasters
  • Severe weather
  • Government restrictions
  • Public emergencies
  • Acts of terrorism
  • Pandemics
  • Venue closures
  • Travel restrictions
  • Other unforeseen events

Performance obligations may be suspended or modified as necessary under such circumstances.

Equipment Malfunction

Company maintains its equipment in good working condition and takes reasonable precautions to ensure reliable operation.

However, Client acknowledges that electronic equipment may occasionally malfunction despite proper maintenance and preparation.

If equipment failure prevents Company from delivering contracted services, Company's liability shall be limited to a prorated refund based on the portion of services not provided.

Company shall not be responsible for indirect, incidental, consequential, emotional, reputational, or special damages arising from equipment failures or service interruptions.

Equipment Damage

Client agrees to take reasonable steps to prevent damage to Company equipment during the event.

Client may be held financially responsible for damage resulting from:

  • Intentional misuse
  • Vandalism
  • Theft by guests
  • Negligence by Client or Client's guests
  • Unsafe conditions created by Client or venue personnel

Normal wear and tear is excluded.

Chargebacks & Payment Disputes

Client agrees to contact Company directly regarding any billing concerns before initiating a credit card chargeback, payment dispute, or payment reversal.

Both parties agree to make reasonable efforts to resolve concerns through direct communication.

Client acknowledges that initiating a chargeback for services properly rendered under this Agreement may constitute a breach of contract.

Company reserves the right to provide this Agreement, payment records, correspondence, event documentation, and other supporting materials in response to any payment dispute.

Limitation of Liability

Company's total liability arising from this Agreement shall never exceed the total amount paid by Client under this Agreement.

Under no circumstances shall Company be liable for:

  • Indirect damages
  • Consequential damages
  • Emotional distress
  • Loss of business
  • Loss of profits
  • Reputational damages
  • Loss of opportunity
  • Third-party claims

Client acknowledges that photo booth services are entertainment services and agrees that any claim arising from this Agreement shall be limited as described herein.

Schedule Delays

Company is not responsible for delays caused by:

  • Venue restrictions
  • Traffic
  • Weather
  • Other vendors
  • Event timeline changes
  • Venue access issues
  • Utility interruptions
  • Circumstances beyond Company's reasonable control

Company will make reasonable efforts to accommodate schedule changes whenever possible.

However, event delays may reduce available service time and shall not automatically extend the contracted rental period.

Additional time may be purchased based on availability and current overtime rates.

Applicable Law

This Agreement shall be governed by and interpreted according to the laws of the State of [STATE].

Any dispute arising from this Agreement shall be resolved in the appropriate courts located within [COUNTY, STATE].

If any provision of this Agreement is determined to be unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement

This document represents the complete agreement between Client and Company.

Any modifications to this Agreement must be made in writing and agreed upon by both parties.
